April 1, 2009 — The Idaho Department of Environmental Quality and the Environmental Protection Agency signed a settlement agreement that required the EPA to approve or disapprove the Pending Arsenic and Cadmium revisions.

July 7, 2008 — Advocates for the West presented Stephan L. Johnson, the administrator of EPA a letter of intent to sue.

The Idaho Department of Environmental Quality (IDEQ) look to settle on a revision to the water quality standards with the Environmental Protection Agency (EPA). The IDEQ proposed to a revision to the water quality standard for arsenic, asking for the Arsenic Criteria to be decreased to 10 ug/L and to bring the low end harness of the Cadmium Criteria down from 25 mg/L to 10 mg/L or less.
